Waukegan criminal defense lawyer Lewis Gainor successfully defended a North Chicago man arrested and charged with resisting a peace officer (a.k.a., resisting arrest).

The man was arrested by the Waukegan Police Department on March 11, 2005 for the Class A misdemeanor of resisting a peace officer. He was facing a fine of up to $2,500 and 364 days in the Lake County jail.

 

When Lewis Gainor took over the case, he recognized it was typical of resisting charges. The police were not arresting the man for any specific criminal offense at the time he was taken into custody. The police officers were only arresting him for “resisting arrest.” This is circular logic, and cannot be the basis of a criminal charge.

 

On December 12, 2006, criminal defense attorney Lewis Gainor appeared with his client in the Lake County Circuit Courthouse in Waukegan. He demanded that the prosecution try to prove its case beyond a reasonable doubt, knowing that they could not do so. As expected, the State dropped the charge.
