Defense attorney Lewis Gainor successfully represented a man who was arrested by the Lindenhurst Police Department for driving under the influence alcohol. The arrest occurred on the night of June 27, 2004. The man was driving home and an officer from the Lindenhurst Police Department tailed him. The police officer pulled the driver over for a minor traffic infraction.

The police officer noticed the odor of an alcoholic beverage and began to ask questions. He wanted to know where the man had been that night, where he was going, and how much he'd had to drink. The Lindenhurst police officer ordered the man to step out of the car and perform field sobriety tests.

The police officer had the driver perform the following field sobriety tests: one-legged stand, walk-and-turn, and finger-to-nose test. Although the driver believed he had passed these tests, the police officer placed him under arrest for drunk driving. The officer had the man's car towed.

Waukegan DUI attorney Lewis Gainor appeared in court with his client on February 9, 2005. His defense strategy was to test the sufficiency of the evidence at trial. The issue for trial was whether the field sobriety tests were performed in accordance with the standards promulgated in the National Highway Traffic & Safety Administration field sobriety testing manual. If the tests were not conducted according to the regulations, the results were unreliable, and could not prove the driver was guilty of driving under the influence of alcohol.
