It was December 2, 2006 at about 3:30 in the morning when Lewis Gainor's client was pulled over. The woman was driving home after going out with her girlfriends. Her route took her through Lake Villa, Illinois.


A squad car from the Lake Villa Police Department followed her car and pulled her over for a traffic violation. The police officer leaned over, peering into the woman's car and shined a flashlight in her face. He questioned her about her alcohol consumption that night, and she admitted that she had drank several beverages of hard alcohol that night. But, she swore to the officer that she had been responsible and that she was able to drive home. She lived nearby in Ingleside, which was not too far away. She begged the police officer to allow her to continue driving home.

 

The police officer told her she was under arrest and placed her in handcuffs. He called a tow truck to impound her car, and transported her in the back of the squad to the police station.

He demanded a trial on March 19, 2007. The prosecution was handled by the Lake County State's Attorney's Office. The prosecutor called the arresting officer and presented the State's case-in-chief. Lewis Gainor then questioned the police, trying to show that there was reasonable doubt as to whether his client was under the influence of alcohol.


The court then considered all the evidence, and rendered the verdict: not guilty.
