Lewis Gainor's client was driving the speed limit and obeying all traffic regulations, but the sheriff's deputy pulled him over anyway. The deputy approached the car and asked for his drivers' license. The man's drivers' license was suspended because of a statutory summary suspension from a DUI arrest. The driver told the deputy this, and the deputy took him out of the car and placed him in handcuffs.

The deputy called a tow truck and had the man's car impounded. Because the man's license was suspended for a DUI, the Lake County State's Attorney's Office initiated vehicle forfeiture proceedings. They intended to sell the car and apply the proceeds to law enforcement funding.

The judge considered the arguments from the People of the State of Illinois and those from Lewis Gainor. The court then sided with Lewis Gainor and entered an order resulting in the dismissal of all charges.
