Illinois suspended/revoked license lawyer Lewis Gainor recently defended a man who was pulled over in a traffic stop by the Lake County Sheriff. It was August 6, 2004, and the man was driving in unincorporated Lake County, Illinois.

Lewis Gainor's client was driving the speed limit and obeying all traffic regulations, but the sheriff's deputy pulled him over anyway. The deputy approached the car and asked for his drivers' license. The man's drivers' license was suspended because of a statutory summary suspension from a DUI arrest. The driver told the deputy this, and the deputy took him out of the car and placed him in handcuffs.
The deputy called a tow truck and had the man's car impounded. Because the man's license was suspended for a DUI, the Lake County State's Attorney's Office initiated vehicle forfeiture proceedings. They intended to sell the car and apply the proceeds to law enforcement funding.

Lewis Gainor filed his entry of appearance as the man's lawyer in the Lake County Circuit Court. He appeared for his client on June 9, 2005, and argued to have the arrest quashed because it was an illegal traffic stop.
