Man is charged with DUI and leaving the scene of an accident. With Lewis Gainor, he pleads guilty only to traffic tickets. Download the court records
Lake County DUI attorney Lewis Gainor recently defended a young man who had been driving in Island Lake, Illinois when he got into an accident. The man had consumed alcohol before getting into his car, so he was afraid he would be arrested fro drunk driving. Because of this, the man decided to drive away from the scene of the accident.
Officers from the Island Lake Police Department were only blocks away from the scene, however. The other driver in the accident called 911 to report the man who had driven away. When the Island Lake police officers got the dispatch, they turned on their sirens and lights and pursued the suspect.
The Island Lake police were able to stop the man only minutes later. They pulled him forcibly out of the car, placed his hands behind his back and cuffed them, and pushed him face first into the hood of his vehicle.
The police officers also noticed that the man smelled of alcohol. They questioned him about how much he drank and began a DUI investigation consisting of field sobriety tests and other observations.
They arrested the man for DUI, and also charged him with failure to reduce speed to avoid an accident, driving on a suspended license, and leaving the scene of an accident. The officers called a wrecker to have the man's automobile towed.
The driver retained Lake County attorney Lewis Gainor to defend him in court on the charges. Lewis Gainor went to court on June 6, 2005. He entered a not guilty plea on behalf of his client and demanded trial. He knew that the Lake County State's Attorney would be unable to prove the charges.
As expected, the prosecution was not able to prove DUI or leaving the scene of an accident. As a consequence, the prosecution dismissed those charges. The man pled guilty to traffic tickets, and was free to go.
