On May 22, 2005, an illegal Mexican immigrant was arrested by the Highwood Police Department for committing a sex offense in public. The victim was a young American woman. Criminal lawyer Lewis Gainor represented the man in Lake County Circuit Court, and took the man’s case to a jury.

 

The story begins at the Walgreen's pharmacy in downtown Highwood near the Metra Station. The Mexican man and his friends went there every Sunday to call home to Mexico and check on their families, and to wire money back home.

 

On this occasion, an attractive American woman in her twenties called the police and report that he was sitting in a car when she walked by, and he assaulted her. She told the police that he pulled down his pants and exposed his penis to her, and masturbated.

 

The Highwood Police Department, which was only blocks away, sent several squads to the scene. Police officers apprehended the suspect and placed him into handcuffs. The police transported the suspect in custody to the Lake County jail, where he was booked and processed. The State’s Attorney reviewed the case and filed charges of a sex offense against him. The sex offenses placed against the man would require him to report as a registered sex offender for a period of ten (10) years. But more importantly, considering the man was not a citizen, that he was in fact, an illegal alien, he would be deported.

 

Defense attorney Lewis Gainor appeared for the man in court and demanded a trial. The prosecution and defense began jury selection on June 1, 2006.

 

Through his questioning, Lewis Gainor was able to get the woman to admit that at the time of the incident, her boyfriend was at a nearby bar, drinking. After the man allegedly exposed his penis and masturbated, the woman went to the bar to tell her boyfriend, not to the police station which was only blocks away. This seemed suspicious. And the boyfriend, instead of going to the police, rushed to the Walgreens and started throwing punches at the man. The phone call which brought the police to the disturbance, it turned out, was actually made by the Mexican illegal.

 

When the jury returned, they gave their conclusions as to what really happened: the woman believed that the Mexican man had looked at her flirtatiously, and she was offended. So, she told her boyfriend, who was drunk. He became enraged with jealously and attacked the Mexican man. And when the police arrived, she was afraid her boyfriend would be arrested for attacking him. Because of this, she fabricated the story about the sex offense. The Mexican man was not guilty.
