Suspension of a CDL for Traffic Tickets

A CDL operator will have his or her license suspended for 2 serious traffic violations in any 3-year period. See 625 ILCS 5/6-514(e).

 

Length of Suspension

  • For 2 serious traffic violations in a 3-year period, the minimum suspension is 2 months.
  • For 3 serious traffic violations within 3 years, the minimum suspension is 4 months.

What is a Serious Traffic Violation?

A "serious traffic violation" can be any number of traffic offenses, many of which do not seem serious. The most common serious traffic violation is speeding 15 MPH or more over the limit. See 625 ILCS 5/6-500.

 

Other Serious Traffic Violations

Both the State of Illinois and the Code of Federal Regulations (CFR) establish traffic offenses that are serious traffic violations. Therefore, even if the Illinois Vehicle Code does not define a traffic offense as a serious traffic violation, the CFR may do so. The following are examples of federal and state-defined serious traffic violations:

  • Following too closely - 49 CFR 383.51(c)(4)
  • Improper or erratic lane changes - 49 CFR 383.51(c)(3)
  • Speeding 15 mph over - 49 CFR 383.51(c)(3)
  • Reckless driving - 625 ILCS 5/6-500

 

Court Supervision and CDLs

Many drivers who have experience with traffic court would believe that court supervision will not affect a CDL. They are WRONG. Court supervision on a serious traffic violation may cause the Illinois Secretary of State to suspend or even revoke a CDL. See 625 ILCS 5/6-500.
