Illinois battery lawyer Lewis Gainor successfully defended a man who was arrested on September 5, 2008 and charged with battery to a police officer. The case concerned an incident that took place in a hospital parking lot in Hines, a village in Cook County. The man was leaving the hospital when he saw the police had placed a ticket on his car windshield and were preparing to tow the vehicle.
The problem was, the hospital posted no signs indicating where it was illegal to park, or that illegally parked cars would be towed. The man had no reason whatsoever to think he was not allowed to park where he did. In fact, after the man's arrest, the hospital posted new parking signs which indicated where parking was permitted and displayed tow warnings.
The man rightfully disputed the tow with the Hines police officers, but they would have nothing of it. What started as a verbal argument about the officers' right to tow the man's car turned into the officers charging him with battery to a police officer. The police handcuffed the man and took him to jail.

The case went to trial on December 9, 2008 and the officers testified in court that Lewis Gainor's client had battered them. The prosecution asked for a guilty verdict and indicated that they would seek a jail sentence if the man were found guilty. Lewis Gainor aggressively questioned the police and made his closing argument to the court, asking the man to be found not guilty.
The verdict: Not guilty. Lewis Gainor and his client walked out of court, vindicated.
