Lake County criminal defense attorney Lewis Gainor recently represented a 20 year-old man who was arrested and charged with trespassing in Gurnee, Illinois. The young man was visiting his friend at an apartment complex, Brook Haven Apartments. The apartment complex had notices posted warning all trespassers that they would be subject to arrest and prosecuted to the fullest extent of the law.
The night of the arrest was June 21, 2006. Before that night, the young man had attended a loud and raucous party on the property. The apartment complex management broke up the party and warned the young man that if he were to return to the property, he would be trespassing, a Class B misdemeanor offense.

The problem was the young man’s closest friends were in the apartment complex, so the management was denying him his right to freedom of association. On the night the man went to the property to see his friends, the management called the Gurnee Police Department, and had him arrested.

The case went to trial on December 26, 2006, and Lewis Gainor aggressively questioned the prosecution witnesses, including the apartment management and officers from the Gurnee Police Department.
